Terms of Service

These terms govern your use of mysite-name's web and mobile development services across England. Please read them carefully before commencing any project to ensure a clear understanding of our operations, client responsibilities, and the development process.

1. Service Agreement

By engaging mysite-name for development services-whether through our website, proposals, or direct agreement-you accept these terms. Our development services operate in compliance with relevant UK business regulations and industry standards.

We provide custom web development, mobile application development, and related digital services to businesses and organisations across England.

2. Project Scope and Deliverables

Our services include web application development, mobile app creation, UI/UX design, and technical consulting. Project scope, deliverables, and specifications are defined in individual service agreements or project proposals.

While we strive to deliver solutions that meet agreed specifications, the nature of custom development means some adjustments may be necessary during the project lifecycle, which we will communicate and agree upon.

3. Client Responsibilities

To ensure successful project outcomes, clients agree to:

  • Provide clear project requirements and timely feedback
  • Designate authorised decision-makers for project approvals
  • Supply necessary materials and access in agreed timeframes
  • Participate in scheduled review meetings and testing phases
  • Provide accurate business and technical information

Active participation and clear communication significantly contribute to project success and timeline adherence.

4. Project Initiation and Planning

All projects begin with detailed requirement gathering and planning. We provide project proposals outlining scope, timelines, deliverables, and pricing. Project commencement requires signed agreement and may require initial payment as specified in the proposal.

Significant changes to project scope after commencement may require revised proposals and adjusted timelines and costs.

5. Intellectual Property Rights

Upon full payment, intellectual property rights for custom-developed work are transferred to the client as specified in project agreements. Pre-existing intellectual property and third-party components remain subject to their respective licenses.

We retain the right to include completed projects in our portfolio unless otherwise agreed in writing, with sensitive business information obscured.

6. Project Timelines and Milestones

We provide estimated project timelines based on scope and complexity. While we strive to meet agreed deadlines, development timelines may be affected by client feedback speed, requirement changes, technical complexities, or third-party dependencies.

We maintain regular communication regarding project progress and will inform you promptly of any significant timeline adjustments.

7. Payment Terms and Scheduling

Payment terms are specified in individual project agreements. Common arrangements include milestone-based payments or monthly billing for ongoing projects. We require payment within 30 days of invoice date unless otherwise agreed.

Late payments may result in project work suspension and may incur interest charges as specified in the Late Payment of Commercial Debts Act.

8. Project Changes and Scope Management

Requests for significant changes to project scope, features, or design after project commencement may require revised proposals. Minor adjustments are accommodated where possible, but substantial changes may affect project timeline and cost.

Change requests are documented and require client approval before implementation to ensure clear understanding of implications.

9. Quality Assurance and Testing

We implement testing procedures throughout the development process. Clients are involved in user acceptance testing phases to verify that deliverables meet requirements. Final sign-off indicates acceptance of delivered work.

While we strive for bug-free delivery, complex software may require ongoing refinement. Post-launch support arrangements are detailed in service agreements.

10. Hosting and Deployment

Deployment and hosting arrangements are specified in project agreements. We can assist with deployment to client-specified environments or recommend hosting solutions. Ongoing hosting and infrastructure costs are separate from development fees.

Clients are responsible for maintaining their hosting accounts and ensuring compliance with hosting provider terms.

11. Confidentiality and Data Security

We treat client information and project details as confidential. Our team members sign confidentiality agreements, and we implement appropriate security measures for project data and source code.

Clients are responsible for ensuring they have appropriate rights to any content, images, or data provided for use in projects.

12. Third-Party Services and Components

Projects may incorporate third-party services, APIs, or open-source components. associated costs and licensing requirements are discussed during project planning. Clients are responsible for ongoing fees for third-party services used in their projects.

We select third-party services based on reliability and suitability, but cannot guarantee uninterrupted service from external providers.

13. Project Acceptance and Sign-off

Projects are considered complete upon client sign-off or after a 14-day review period following our notification of completion. After sign-off, additional work may be handled as support requests or new project phases.

Final payments are due upon project completion as specified in service agreements.

14. Limitation of Liability

Our liability for projects is limited to the value of services provided. We cannot accept responsibility for business losses, data loss, or indirect damages resulting from project work, though we maintain professional indemnity insurance as appropriate.

Clients are responsible for ensuring they have adequate backups and business continuity arrangements.
